Charges likely after passenger ejected
Gainesville woman is 4th fatality of 10

Authorities say a Dawsonville man likely will face charges after a passenger fell out of the Jeep he was driving Friday night on Ga. 400 and was killed when hit by an oncoming minivan.

  

Jenna Annette Fitzgerald, 24, of Gainesville died at the scene of the incident, which occurred near Carlisle Road about 10:20 p.m. June 25.

  

The driver of the Jeep, 43-year-old Colon Louis Hartzler, was traveling south on Ga. 400 when authorities said he attempted to turn left onto Carlisle Road in Dawson County.

  

Fitzgerald was thrown from the Jeep into a northbound lane, according to Georgia State Patrol reports.

  

A spokeswoman with the state patrol said Monday that Hartzler stopped to help Fitzgerald and was also struck by the passing Ford Freestar.

  

The driver of the minivan, 20-year-old Michelle Nicole Chirillo of Dawsonville, was not charged.

  

Hartzler was flown to Grady Memorial Hospital in Atlanta with what were described as non life-threatening injuries.

  

According to the state patrol, he likely will be charged in the incident, which appeared to have involved alcohol.

  

As of Tuesday afternoon, Hartzler’s condition was stable according to the state patrol.

  

The incident remains under investigation by the state patrol.

  

Funeral services for Fitzgerald, who attended North Forsyth High School, were held Tuesday at Memorial Park Funeral Home in Gainesville.

  

She is survived by her parents, Johnny and Judy Fitzgerald, and brother, John Fitzgerald Jr., all of Gainesville.

  

The wreck is the county’s fourth traffic death of 2010 and second in 10 days. 

  

On June 15, a 23-year-old Dawsonville man was killed when his motorcycle collided with a pickup truck at Recreation Road and Hwy. 9 North.

  

In April, a 64-year-old Dahlonega woman died in a two-vehicle, head-on wreck at Hwy. 53 and Thompson Road.

  

Also that month, a 71-year-old Dawsonville man died in a collision with a tractor trailer on Hwy. 53 East, between War Hill Park and Dawson Forest roads.
