Store cleared to sell beer, wine to public

New owner cautioned of prior violations

POSTED: June 11, 2014 4:00 a.m.

A convenience store in southern Dawson County is once again able to sell beer and wine.

County commissioners approved the alcohol license application for the Hwy. 9 Silver City Citgo on Thursday, after former managers at the store were arrested March 8 in connection with an alleged illegal gambling sting.

According to the county's alcohol ordinance, an alcohol license can be suspended for "a violation by the licensee of any state or federal law or regulation."

Instead, the previous owner surrendered the alcohol license to the county's planning department.

"In essence, there was no suspension because there was no license to suspend, so we then took an application for a new alcohol license for that location," said Dawson County Planning Director David McKee.

The store is being operated by a new tenant with no affiliation to the prior merchant, according to McKee.

"The applicant proved there is no relation to the previous tenant," he said.

Commissioners last week did issue a caution to the new owner, saying violations of the county's alcohol ordinances would not be tolerated.

"We take a dim view on selling to underage and unlawful activities that has just been going on at that location," said Commissioner James Swafford. "If it comes back before us ... you can count on us enforcing our ordinances."
