County seeks back taxes from business

County officials are once again seeking legal action against a local hotel owner over delinquent taxes.

As of Tuesday afternoon, Comfort Inn on Beartooth Parkway was more than $11,000 behind in hotel/motel taxes, according to Dawson County Manager Cindy Campbell.

Last week, county commissioners voted to move forward with legal action against the business, which operates as Spectrum Management and is owned by Vilas Patel, to recoup the money.

With the vote, the board also gave county staff the authority to legally pursue the recovery of any subsequent delinquent taxes in the event the business falls behind in the future.

"This has been an ongoing problem where this same hotel becomes delinquent and each time we've been coming to the board requesting to move on to court with the issue," Campbell said. "Spectrum Management is the only hotel that we've had ongoing ... the same issue."

In the past year, the business has been more than 90 days delinquent at least three times, though the taxes are typically remitted within a few weeks of notification that the county plans to seek legal action, officials have said.

The county also pursued legal action against the business in May 2012 when management was nearly $10,000 behind in hotel/motel taxes.

The delinquent taxes were eventually paid.

According to the county's resolution on excise tax, penalties, interest and court fees could be added to the total owed.
